Abstract
The regulations regarding abortion are found in the criminal law and maternal and children¢¥s health law in Korea. The regulations are very strict. These laws show that these laws assume that a fetus has an incomplete but a strong right to life. The consistency of these regulations to the constitutional law can be of question.

Any direct or indirect implication regarding fetal right to life can not be found in the constitutions. For the constitutions to provide a viewpoint regarding fetal right to life, it must be reasonable and there are many interpreted viewpoints from the constitutions which are still reasonable.

Hence it is obvious that the constitutions do not take any certain viewpoint regarding fetal right to life. According to this, the criminal law and the maternal and children¢¥s health law which take only one viewpoint regarding fetal right to life must be revised
